Obtaining a Digital Nomad residence permit in Spain. Service offer

The Digital Nomad residence permit is intended for remote workers of foreign companies, as well as for self-employed individuals who provide services to foreign customers.
The Digital Nomad residence permit is regulated by Law 28/2022 of 21 December 2022 on the promotion of the ecosystem of emerging companies (also known as the Startups Law). In particular, it amends Law 14/2013 of 27 September 2013 on support for entrepreneurs and their internationalization and introduces the concept of an international remote worker. First applications could be submitted at the beginning of 2023.

Advantages of the programme

  • allows living in Spain;
  • allows visa-free travel to the Schengen countries;
  • allows obtaining a residence permit for the main applicant’s family members: spouse; minor children, and adult children, provided that they are unmarried and financially dependent on the main applicant; parents, provided that they are financially dependent on the main applicant;
  • allows applying for a permanent residence permit after 5 years of being a resident, and applying for citizenship after 10 years.

Basic requirements for the applicant

  • be a national of a non-EU and non-EEA country;
  • be self-employed providing services to foreign customers or work as an employee for a company incorporated outside Spain using only computer and telecommunications facilities and systems;
  • have a monthly income of at least 200% of the minimum interprofessional wage (SMI)* – approximately EUR 2 650; in the case of visa application for family members, it is necessary to prove having additional funds of at least 75% of the SMI (EUR 993) for the spouse and at least 25% of the SMI (EUR 331) for each child.

*In 2024, the SMI is EUR 1 134 per month, calculated as 14 payments in a year, which put the annual total at EUR 15 876.

Basic documents to apply for a residence permit

  • copy of the passport, colour photo, government fee payment receipt;
  • employment contract (for employees) or a contract for professional services (for the self-employed), the period of previous employment or contractual relationship must be at least 3 months at the time of the application;
  • letter from the employer or the customer company specifying the position, length of service, salary and the possibility of remote work from Spain;
  • extract from the register of commercial companies specifying the date of establishment and types of activity of the employer company or companies to which the self-employed applicant provides services, the period of continuous operation of these companies must be at least 1 year;
  • copy of diploma or proof of professional experience of at least 3 years;
  • letter of undertaking to pay social security contributions in Spain or a certificate of payment of social security contributions by the employer (depending on whether the applicant is self-employed or an employee and whether the employer’s country of residence has a social security agreement with Spain);
  • certificate of no criminal record from the country or countries where the applicant has lived for the last 2 years;
  • health insurance;
  • in the case of visa application for family members – proof of relationship: marriage certificate, birth certificate, etc.

This list is not exhaustive.

Application procedure

There are two options:

1. Apply for a visa at the Spanish consulate in the applicant’s country of permanent residence. In this case, the applicant first obtains a national Visa D valid for 1 year, enters Spain on this visa and applies for a 2-year residence permit in Spain.

2. Apply from inside Spain (having travelled to Spain on a tourist visa). In this case, the application is made straight away for a residence permit, the validity of the residence permit is 3 years.

The application assessment time is 21 working days.

This is the option that we recommend.

What obligations holders of a Digital Nomad residence permit have in Spain

  • not to be away from the country for more than 6 consecutive months;
  • tax obligations;
  • for the self-employed – obligation to pay social security contributions.

Renewal of a Digital Nomad residence permit

The residence permit can be renewed for up to 5 years, provided that the applicant continues to meet all the requirements for this type of residence permit.

· filling in and submitting the residence permit application and supporting documents to the Spanish migration authority electronically using a lawyer’s electronic certificate;
· assistance with payment of government fees and charges for a residence permit;
· providing explanations and documents to the migration authority if the migration authority has any additional questions;
· following up on the application and notifying the applicant of the decision.

  • 70% payable in advance;
  • 30% payable before submitting the application to the migration authority.

Payable by the applicant additionally:

  • translation and certification of documents,
  • health insurance,
  • government fees and charges for a residence permit.

[1] The fees are valid as of October 2024, for applications made from within Spain, and do not include VAT.
